Physical Injury Workers Compensation

Protecting Workers in High-Risk Industries:

Healthcare, Construction, and Manufacturing

Healthcare, Construction,
and Manufacturing

In physically demanding workplaces, such as healthcare, construction, and manufacturing, injuries are unfortunately all too common. These industries expose workers to hazards like heavy lifting, machinery, and repetitive strain, often resulting in injuries that can have a long-lasting impact on their ability to work. At Fern Lawyers, we understand the seriousness of physical workplace injuries and are committed to helping injured workers secure the compensation they deserve.

Understanding
Physical Health Injury
Workers Compensation

Physical injuries in the workplace can include anything from, sprains, and soft tissue injuries to more serious conditions like fractures, chronic back injuries with nerve impingements, repetitive strain injuries (RSI), or traumatic incidents involving machinery. These injuries can be devastating, impacting not only a worker’s physical health but also their financial stability. Healthcare workers, construction workers, and manufacturing operators are especially vulnerable due to the nature of their work environments.

Workers compensation for physical injuries is designed to provide financial support to workers who are unable to perform their job duties due to these injuries. Compensation can cover medical expenses, lost wages, and rehabilitation costs, allowing individuals to focus on their recovery and eventual return to work. At Fern Lawyers, we specialise in navigating the complexities of physical injury compensation claims, ensuring that our clients receive the support and financial aid they are entitled to.

Case Study:

The Critical Impact of

Workplace Injuries in
High-Risk Jobs

What happened?
In December 2018, our client was working on a construction site installing gutters onto a roof, when the truss he was standing on gave way and he fell more than three metres to the ground. As a result, he severely injured both of his shoulders and bicep and was unable to work due to the injury.
How we helped
Our client contacted Fern Lawyers with little knowledge of how the compensation process worked. With the support of his legal team, we worked together to advise and implement several strategies to maximise compensation and expedite the claims process, running a permanent impairment claim alongside the workers compensation claim to assist with medical expenses and ongoing loss of income.
Going forwards
We were able to secure a lump sum for permanent impairment for over $54,000. But we didn’t stop there. We managed commenced a negligence claim against the employer and the builder of the site, recovering over $950,000 in compensation plus costs. Throughout the proceedings, the Fern Lawyers team helped him secure ongoing funding to assist with medical expenses and loss of income. Working tirelessly to achieve the best outcome for the client, we are confident that we will continue to secure further funds to help him recover from the injury.

Challenging the Stigma

Workers
Compensation:
Not Just for
Minor Injuries

One of the most pervasive and harmful myths surrounding workers compensation is the belief that it’s a system that people exploit. This belief can be harmful in high-risk professions, where serious injuries are a regular occurrence. Workers in healthcare, construction, and manufacturing often feel hesitant to make a claim, fearing stigma or retribution from their employer.

At Fern Lawyers, we challenge this notion every day. Physical injuries can range from moderate to life-altering, and no injury should be minimised. Workers compensation is a critical system that exists to ensure workers are protected and supported during recovery. We advocate for injured workers, ensuring they are treated fairly and receive the compensation they need to rebuild their lives.

It’s crucial to remember that workers compensation is a right for all injured workers, no matter how severe the injury. By dismantling harmful myths about the system, we aim to help our clients navigate the process with confidence and focus on their healing and rehabilitation.

What is a physical injury at work?
A physical injury is any kind of harm to your body that arises during the course of your employment. This could be things like sprains, fractured bones, cuts, burns, back pain, or injuries from doing the same movements over and over, or from accidents on the job. It could also include stomach problems due to pain medicine or poor sleep due to pain.
Who pays for workers’ compensation?
All NSW employers are legally required to have Workers Compensation insurance to protect their staff and help if you’re injured at work. If your claim is approved, the insurance may pay you weekly benefits and reasonably necessary medical treatment expenses to help you with your recovery and getting back on your feet.
What happens if I can’t return to my old job?
If your injury makes it hard to go back to your old job, workers’ compensation can help. They may support you with rehab or retraining, so you can find a new job that fits your abilities and keeps you moving forward. Talk to us today to understand more.
How do I access free NSW Government Funded Advice?
Thanks to the changes made to workers’ compensation by the NSW Government in 2012, lawyers access government funding on your behalf, so you don’t pay for advice out of pocket.
Do I need a Certificate of Capacity?
The simple answer is yes. Issued by your treating doctor, in NSW a Worker’s Compensation Certificate of Capacity is vital, as it’s a key communication document to ensure all involved parties receive the same information in relation to your injury. It also helps to inform your injury management and recover at work plans.
